Changing your child’s registered first name in the Netherlands is only possible through the district court (rechtbank), and only if there is a sufficiently weighty reason for the change. The parent with parental authority (gezag) or the guardian files the request through a lawyer; children aged 8 and older are invited by the court to give their view.

The rules are in Article 1:4 of the Dutch Civil Code (BW). The court grants the request if the change serves a weighty interest and the new name is not inappropriate and not identical to an existing surname, unless that is also a common first name.

Dè a tha a’ meas mar ùidh a tha cudromach gu leòr do phàiste?

The court looks at the child’s own situation, not at an abstract standard. Grounds the Dutch judiciary (Rechtspraak) mentions include bullying, psychological distress, religion, adoption, a change of registered gender and a harmful meaning of the name in another language.

A bheil e gu diofar dè an t-ainm a th’ air a’ phàiste dha-rìribh?

Yes. If a child has used a different name at home and at school for years, that everyday use is strong evidence: school records, medical records and statements from teachers show that the interest is real.

The child’s own view also counts. The district court invites children aged 8 and older by letter for a conversation with the judge (kindgesprek), and as children grow older their wishes carry more weight.

What if the other parent does not agree?

If only one parent files the request, the lawyer must add a statement from the other parent agreeing to it, or explain why it is missing. The court notifies the other parent and, where relevant, the certified institution supervising the child, and both may object.

An objection can be made orally at the hearing or in a written defence (verweerschrift). A written defence must be filed by a lawyer, no later than 2 days before the hearing.

An e an aon dòigh-obrach a th’ ann mearachd a cheartachadh?

No. A spelling or transcription error on the birth certificate is a correction of the record, not a change of name, and does not require a weighty interest. Obvious errors can often be corrected through the municipality where the birth was registered; others need a separate, simpler court procedure.

Ciamar a tha am modh-obrach ag obair?

A lawyer is mandatory: you cannot file the petition (verzoekschrift) yourself. The lawyer files it with the district court with a BRP extract, the birth certificate and an extract from the Central Custody Register (Centraal Gezagsregister).

The court often decides on the papers, but can hold a hearing at the court for your place of residence. The decision (beschikking) goes to your lawyer. You or an objecting parent can appeal to the court of appeal (gerechtshof) within three months, again through a lawyer.

Once the change is granted, the court sends the decision to the municipality where the child was born, or to The Hague municipality if the child was born abroad. The municipality then updates the name in the Personal Records Database (Basisregistratie Personen, BRP).

The court charges a filing fee (griffierecht) according to the civil fee table, plus the lawyer’s fees. Applicants with a low income can ask their municipality for special assistance (bijzondere bijstand) towards the court fees.

Dè mu dheidhinn sloinneadh atharrachadh na àite?
